TERMS AND CONDITIONS OF PURCHASE

1. General Provisions. 1.1. These terms and conditions of purchase and sale of goods (hereinafter "Rules") are a legally binding document for the parties, which establishes the rights and obligations of the Buyer and the Seller (Kristina Bajorienė), the conditions for purchasing and paying for the goods, the procedure for delivery and return of the goods, the liability of the parties and other provisions related to the purchase and sale of goods in the online store "Smagu visiems". 1.2. By placing an order, the Buyer confirms that they agree with these Rules. 1.3. The contract between the Buyer and the Seller is considered concluded from the moment the Buyer, having formed a shopping cart in the online store, specified the delivery address, selected the payment method, and read the Rules, clicks the "Buy" button.

2. Personal Data Protection.  2.1. When ordering goods in the online store "Smagu visiems", the buyer must provide the data requested during the purchase: name, surname, address, and email address. 2.2. The Buyer is responsible for providing correct data during the purchase. 2.3. By placing an order, the Buyer agrees that the personal data provided by them will be processed for the purpose of order fulfillment. The Buyer also agrees that informational messages necessary to fulfill the order of goods will be sent to the email address provided by the Buyer. 2.4. The Buyer's personal data may be processed for marketing purposes only if the Buyer themselves expresses consent to this. 2.5. The Seller undertakes not to disclose the Buyer's personal data to third parties, except when required by a competent State institution in cases provided for by the laws of the Republic of Lithuania or with a separate written consent of the Buyer.

3. Buyer's Rights and Obligations. 3.1. The Buyer undertakes to pay the Seller the agreed sum for the ordered goods and to accept them. 3.2. To provide full, detailed, and correct information in the payment form. If the Buyer provides inaccurate, false, or misleading data in the payment form, the Seller has the right to cancel the Buyer's registration and delete the data. 3.2. If the Buyer's data provided in the purchase form changes, the Buyer must immediately inform the Seller. 3.3. The Buyer has the right to withdraw from the contract of purchase and sale of goods, following the provisions set out in the Goods Return rules. 3.4. By placing an order in the online store "Smagu visiems", the Buyer agrees to these Rules of purchase and sale and undertakes to comply with them and the established legal acts of the Republic of Lithuania.

4. Seller's Rights and Obligations. 4.1. The Seller undertakes to create all conditions for the Buyer to properly use the services provided by the online store "Smagu visiems". 4.2. If the Buyer tries to harm the stability and security of the online store's work or violates their obligations, the Seller has the right to immediately and without notice limit, suspend or revoke the Buyer's access to the online store. 4.3. The Seller undertakes to respect the Buyer's right to privacy of the personal information belonging to the Buyer, specified in the purchase form, and not to transfer it to third parties. 4.4. The Seller undertakes to deliver the goods ordered by the Buyer to the address specified by the Buyer. 4.5. The Seller, in the event of important circumstances, may temporarily or completely terminate the operation of the online store without prior notice to the Buyer. 4.6. The Seller may unilaterally change the conditions of these Rules. 4.7. If the Buyer uses the services provided by "Smagu visiems" after changes to these conditions, it is considered that the Buyer has agreed to the change of the Rules.

5. Ordering Goods, Prices, Payment Procedure, Deadlines. 5.1. The Buyer can buy online in the online store 7 days a week, 24 hours a day. 5.2. Orders are accepted only using the Online store "Smagu visiems". 5.4. All prices of goods in the online store are indicated in euros. 5.5. The Buyer undertakes to pay for the order within 2 (two) calendar days from the date of order confirmation. The preparation of the parcel starts only after receiving payment for the goods. 5.6. If the Buyer fails to make the payment within 2 calendar days, the order is canceled.

6. Delivery of Goods. 6.1. The Buyer undertakes to specify the exact place of delivery of the goods. 6.2. The Buyer undertakes to accept the goods themselves. In the event that the Buyer cannot accept the goods themselves, and the goods have been delivered to the specified address, the Buyer has no right to make claims to the Seller regarding the delivery of goods to the wrong entity. 6.3. The goods are dispatched to the Buyer within 2 working days after confirmation of payment. 6.4. In all cases, the Seller is released from liability for failure to meet the deadlines for delivery of goods, if the goods are not delivered to the Buyer or are delivered late due to the fault of the Buyer or due to circumstances beyond the Seller's control. 6.5. The Buyer must immediately inform the Seller if the parcel is received in a damaged package, if unordered goods or an incorrect quantity thereof, or incomplete assembly of the goods are received in the parcel. 6.6. The Buyer must email photos of the damaged parcel and/or item(s) to the Seller.

7. Quality of Goods, Warranties. 7.1. All data of the goods sold in the online store "Smagu visiems" are indicated in the item description accompanying each item. 7.2. The quantities of goods depicted in the photos in the store are not always related to the price of the item – more than one unit price of goods may be depicted. Units of measurement are specified in the item description. The color of the goods may vary slightly depending on the monitor used by the Buyer. 7.3. The Seller may provide an appropriate quality guarantee for individual types of goods, the specific term and other conditions of which are specified in the item description.

8. Marketing and Information. 8.1. The Seller may organize various promotions and offers in the online store "Smagu visiems". 8.2. The Seller has the right unilaterally, without separate notice, to change the conditions of the promotions, as well as to cancel them. Any change or cancellation of the conditions and procedure of the promotions is valid from the moment of their change or cancellation. 8.3. The Seller sends notices to the Buyer to the email address specified in the Buyer's purchase form. 8.4. The Buyer sends all messages and questions to the contacts specified in the "Contacts" section of the Seller's online store. 8.5. The Seller is not responsible if the Buyer does not receive sent informational or confirmation messages due to internet connection, email service provider network disruptions, messages going to the SPAM folder, or due to data incorrectly specified by the Buyer. 8.6. The Buyer's personal data may be processed for marketing purposes under the conditions specified in clause 2.4 of these Rules.

9. Final Provisions. 9.1. These Rules of purchase and sale of goods are drawn up in accordance with the laws and legal acts of the Republic of Lithuania. 9.2. These rules are governed by the law of the Republic of Lithuania. All disagreements arising from the implementation of these rules are resolved by negotiation. If an agreement cannot be reached, disagreements are resolved in accordance with the procedure established by the laws of the Republic of Lithuania.

RULES FOR RETURN OF GOODS

1. Return and Exchange of Goods. 1.1. The return of goods takes place in accordance with the Order of the Minister of Economy of the Republic of Lithuania No. 217 of June 29, 2001, "On the approval of the rules for the return and exchange of items". 1.2. The Buyer must send the returned goods by registered mail. The registered mail number must be provided to the Seller no later than 24 hours after dispatch. 1.3. The return costs of returned quality or exchanged goods are paid by the buyer. 1.4. If the Buyer wants to return the item(s), they can do so within 7 (seven) days from the day of delivery of the goods to the Buyer, by informing the Seller by email, attaching photos or videos of the item and/or parcel describing the problem that has arisen. 1.5. The returned item must be in its original neat packaging, undamaged, unused, in the same assembly as the Buyer received it, without having lost its commercial appearance (intact labels, unpeeled protective films, etc.). When returning the item, it is necessary to present a paper (printed) document of its purchase (copy of the order, transfer). 1.6. When returning a quality item, only the amount of money paid for the item is returned to the Buyer. Shipping costs are not refunded to the buyer. 1.7. Upon returning the wrong item received, the Seller undertakes to replace such item with the required item. If the required item is not available, all money (for the item and the actual shipping costs incurred) is returned to the Buyer. 1.8. When a defective item is returned, the Seller undertakes to replace the defective item with an analogous item or return the money to the Buyer. 1.9. If the Buyer wants to return a defective item(s), they can do so within 14 (fourteen) days from the day of delivery of the goods to the Buyer, by informing the Seller by email, attaching photos or videos of the defective item and/or parcel describing the problem that has arisen. 1.10. The returned defective item must be in its original neat packaging, undamaged, unused, in the same assembly as the Buyer received it, without having lost its commercial appearance (intact labels, unpeeled protective films, etc.). When returning the item, it is necessary to present a paper (printed) document of its purchase. 1.11. The Seller has the right not to accept the goods returned by the Buyer if the Buyer does not comply with the procedure for returning goods established in clauses 1.4-1.5, 1.9-1.10 of these Rules. 1.12. If the Buyer paid for the item with a gift voucher, the voucher and other additionally paid amount (if it was paid) are returned. 1.13. If the Buyer returns an item bought at a discount, the amount paid for the item with the valid discount is returned.

2. Final Provisions. 2.1. These Rules for the return of goods are drawn up in accordance with the laws and legal acts of the Republic of Lithuania. 2.2. These rules are governed by the law of the Republic of Lithuania. All disagreements arising from the implementation of these rules are resolved by negotiation. If an agreement cannot be reached, disagreements are resolved in accordance with the procedure established by the laws of the Republic of Lithuania.
